Article II, Section 2. Pursuant to this authority, many years ago the Board enacted the Code of Conduct that is found posted on the walls of virtually every room that makes up our common area facilities.
Without restating the entire Code of Conduct here which is found in its entirety at the end of this article , in a nutshell it requires members to conduct themselves so as to not interfere with the rights and privileges of other members, occupants, or guests. Behavior such as using loud, profane, indecent or abusive language is prohibited, as is harassment, physical abuse, or unsafe activity.
The Code of Conduct is designed to protect not only other members, but all occupants, guests, Association employees, directors, officers, and committee persons. A member is responsible for not only themselves but also for the conduct of their occupants and guests. Any member who violates the Code of Conduct is subject to disciplinary action which may result in sanctions including but not limited to suspension of the right to use Association facilities, or imposition of a monetary fine.
It is the Code of Conduct Committee that is tasked with determining whether a violation has occurred, and if so, what sanction is commensurate to the violation. Initiation of the process commences when a written complaint is filed with The complaint is then forwarded to the Sun City Grand Code of Conduct Committee, which consists of 12 fellow volunteer members who give of their time and talents to provide a respectful and fair process to those involved in an alleged Code of Conduct violation, whether victim, accused or witness.
Upon receipt of a Complaint alleging a Code of Conduct violation, the CAM General Manager will notify in writing the person accused of the violation, giving them an opportunity to provide a written response at this stage. If the Code of Conduct Committee decides that no potential violation has occurred, the complaint will be dismissed with no further action. If the Committee determines that a potential violation has occurred, the Chair will appoint an Investigating Panel consisting of the Chair or Vice Chair, along with three other members.
The Investigating Panel will then set a Hearing Date, and notice the accused, the complainant, and any known witnesses. The Hearing is done in an informal setting. The typical procedure is for the Investigating Panel to hear from the complainant first, followed by any witnesses. The Investigating Panel will then hear from the person accused of the violation if they chose to attend, as well as any witnesses.
All people appearing before the Investigating Panel do so individually,. Once the complainant, accused and witnesses have been heard, the Investigating Panel members then privately deliberate to determine based on the evidence gathered whether sufficient grounds exist to establish a violation of the Code of Conduct. If the Investigating Panel members determine a violation has occurred, the members then discuss the appropriate sanction, designed to be proportional to the violation.
If all Investigating Panel members are in agreement as to the sanction, the matter is concluded. The accused is notified in writing of the findings and the imposition of sanctions. The General Manager may require that the complaint be submitted in writing before taking action on the complaint. Members shall obey all safety rules and shall cease and desist all unsafe activity. Members are prohibited from profiting financially from their membership by charging occupants or guests for use of the Association Facilities.
